Generality

Offers, order confirmations and invoices are made, understood and accepted, under the general sales conditions below. No variation and/or additional conditions will be effective unless agreed between the parties and confirmed in writing by Gambilongo Caffè srl. Each additional supply or supply will be made separately from the main order.

Irrevocability of the order

The order remains binding and irrevocable by the Buyer for 30 days. from the date of subscription, while it is reserved to the unquestionable judgment of Gambilongo Caffè srl. the acceptance or not of the order itself. The order is accepted if confirmed in writing by Gambilongo Caffè srl. within 30 days of its receipt or if it has started delivery within the same period. Also in the latter case the order will be deemed accepted under the special and general conditions of the commission.

Offers

The offers sent by Gambilongo Caffè srl are considered to be accepted when the latter receives from the Buyer relative written confirmation. Any changes made by the Buyer to the offer conditions must be in turn confirmed in writing by Gambilongo Caffè srl pursuant to art. 1326 C.C. All offers sent by Gambilongo Caffè srl are intended at the prices in force at the time of their issuance, but against any changes in the price lists, it is the faculty of Gambilongo Caffè srl. vary the selling prices, without prejudice, in this case, to the Buyer’s right to cancel the order in question. All offers are subject to availability of the product.

Products

Gambilongo Caffè srl reserves the right to make any changes it deems necessary to its products at any time and without prior notice. Therefore, the illustrations and data reported in the catalogues, on the site, offers and price lists are purely indicative and subject to possible variations.

Prices and payments

The prices indicated for the products and services offered are expressed in Euro, excluding VAT and transport costs, special packaging, while the cost of a standard packaging is included. The possible cost of transport is indicated during the order confirmation.

Payment must be made according to the selected payment method. In case of delay in payments will be due to Gambilongo Caffè srl. the default interest pursuant to art. 4 and 5 of Legislative Decree 231/2002 and succ. mod. except for major damages, without the application of art. 1224, second paragraph c.c., to which the parties expressly declare to derogate. In addition, the amounts due will be subject to revaluation in order to hold Gambilongo Caffè srl free from any monetary devaluation between the day on which the payment was due and the day on which the payment was made.

In the event of default by the Customer with respect to any payment, even partial or installment, due to Gambilongo Caffè srl, Testo reserves the right to suspend the execution of the contract or to terminate it pursuant to art. 1453 Civil Code, subject to damages.

Your payment data is transmitted to Passepartout servers via a secure https connection. The transmission takes place exclusively for the purposes of processing your payment.

Delivery

The terms of delivery of the goods indicated in written estimates, minutes, offers, or commissions, while being respected as far as possible, are only indicative and Gambilongo Caffè srl will not be liable for any damages resulting from delays in delivery not attributable to it.

Gambilongo Caffè srl undertakes to notify the Customer of any delays in the processing of orders compared to the terms indicated in the order proposal where the expected delay is more than 15 days. In this case, the Customer may cancel the order by means of a written note to be sent to Gambilongo Caffè srl within three days of receiving the notice of the delay.

Retention of title

Ownership of the goods sold by Gambilongo Caffè srl will be transferred only when the Customer has fully paid the consideration due on the basis of the order made. The risk relating to the products sold is transferred upon delivery of the goods.

Complaints and liability

All apparent defects of the goods, not attributable to events occurred during and/or related to transport, must be reported by written notice of the Customer received by Gambilongo Caffè srl within 8 days. (eight) from the date of receipt of the products. The complaint must contain all the data relating to the name or business name of the recipient, the holder of the invoice, with an indication of the invoice number, description of the product, serial number of the goods, defect found.

In no case is the recipient of the goods allowed to tamper with, disassemble or modify the product with respect to the original conditions in which it was delivered, Under penalty of disclaimer of all liability to Gambilongo Caffè srl and will not accept the return of goods by the Customer unless previously agreed in writing, with the original accessories and packaging and free port.

Guarantee

The terms of warranty of the materials are indicated in the manuals of the individual articles and may vary for their spare parts in the case of parts subject to wear or consumption. In order to maintain the efficiency of the instrumentation listed in the offer, Gambilongo Caffè srl will replace at its sole discretion, indicating to the customer the components or parts worn or consumed that may affect the correct functioning of the appliance. Replacement will be free of charge, if required by the contract.

Jurisdiction and applicable law

Exclusive jurisdiction for any dispute relating to sales and related contracts concluded with Gambilongo Caffè srl. is that of Cosenza. For what is not provided for by these general conditions of sale, the Italian law is applicable to the sales concluded by Gambilongo Caffè srl as it does not derogate from the same conditions.
